THE LEGAL FOUNDATIONS OF THE BIOSPHERE

Abstract


The conflict between the Mankind and the biosphere is caused by the biological nature of Homo sapiens as a consumer species. During its civilizational evolution, the Mankind only developed its extraordinary skills to consume biospheric recourses. A result is the deterioration of biodiversity, which is essential for sustainability and self-repair of the biosphere. A possible approach to ameliorating the severity of this conflict is to introduce a new legal concept – the right of the biosphere to be not destroyed. This attitude may make another incentive to develop novel technologies, such as based on solar energy or waste utilization, allowing humans to acquire novel functions of producer and reducer species.
