THE ISSUE OF GENOMIC DATA SECURITY

Abstract


In order to secure data about certain DNA segments – the genomic information – against criminal encroachments, it is expedient to fortify further the means of protection of such information from possible leaks. In this regard, it is not fully correct to refer the genomic information about a subject to his/her personal data as it is stipulated in the Law on Personal Data. Obviously, this information relates to not only a defined person, but to an indefinite range of persons, including all direct relatives, such as parents and progeny. Therefore, genomic information should be granted with a special juridical status. It should be separated from personal biometric data into a special type of data about indefinite range of persons. Securing such information can be ensured only if the responsibility for its acquisition, storage, and usage is taken by the state, similarly with already recognized types of sensitive forensic information.
